PROOF OF AUTHORITY
(ANCILLARY PROBATE)
This process is done if there is already a probate open in another state but there is real property here in Arizona that needs to be sold or transferred to an heir(s). We petition the court to accept the appointment in the original court and transfer those rights to property in Arizona.

If you will be transferring the property to an heir, we will need to do that through a Deed of Distribution process. That process will run approximately $300 or more depending on the county we need to record the deed in.
SUBSEQUENT ADMINISTRATION
A Subsequent Administration is done for 2 different reasons. The first is to re-open a probate that has been closed for more than 1 year. If you find additional assets after you have closed out a probate, you will need to re-open the original probate with the court so that you can administer the newly found property. The second reason is to appoint a Successor Personal Representative if the first representative has died.

SPECIAL ADMINISTRATOR
This process is done if there is no known family or the presence of a Will is unknown. A special administrator has a limited appointment time (usually 3-4 months) for the sole purpose of securing the decedent’s property (assets) and finding any known relatives or a Will/Trust document. This appointment does not allow for selling/transferring/donating of assets.

DEED OF DISTRIBUTION
When a piece of real property is in probate and it is going to be distributed to an heir or heirs instead of being sold, we have to do a Deed of Distribution and record specific documents showing the personal representative had the right to distribute the property.
That process will run $175 depending on the county we need to record the deed in.
Typically we will also need to record the deed, death certificate and court approval – those recordings run $30-$40 each, depending on the county we are recording in.
